Release of Liability, Agreement to Hold Harmless and Indemnify, and
Assumption of Risk
The completion of this form is required by all participants taking part in Seagypsy
Expeditions. By signing this Agreement, each participant on a sailing expedition
or voyage waives all claims against Barbara Molin and Seagypsy Expeditions, for
injury, accident, illness or death during or by reason of their participation in a
sailing expedition, on the sailing vessel Eidos.
I, ___________________________________ (name of applicant) do hereby
acknowledge that I am aware that during the voyage I will be taking part in,
certain risks and life threatening dangers may occur, including but not limited to,
the dangers of sailing in the open sea, storms, shipwreck, high winds, travel
ashore in remote locations, falling overboard, accidents or illness in remote
locations with little or no access to rapid evacuation or medical facilities.
I understand that Barbara Molin and Seagypsy Expeditions will have no liability
regarding the provision of medical care or the competence of any medical care
that may be given. I have read the Ship's Articles as supplied with this application
and agree to abide by these rules while on board Eidos or ashore during the
voyage.
In consideration of the Agreement with Seagypsy Expeditions to participate in this
, I agree to assume all risk of this trip and I will not make any claims against
Barbara Molin or Seagypsy Expeditions or sue for bodily injury, emotional
trauma, death or property damage, resulting from negligence or
unseaworthiness of the vessel, or other acts, however caused, as a result of my
participation in this expedition. I therefore release, indemnify and discharge
Barbara Molin and Seagypsy Expeditions from all claims, actions and demands
that I may have for bodily injury, death or property damage arising from my
participation in this expedition.____________ (applicant's initials).
This release of liability, agreement to hold harmless and indemnify, and
assumption of risk agreement is entered into on behalf of all members of my
family, including any minors. If any person makes a claim on my behalf, I, or my
estate will indemnify and hold harmless Barbara Molin and Seagypsy Expeditions
from any loss, including legal fees incurred in the defense of such claims. This
agreement is binding on my heirs, legal representatives and assigns. If any
portion of this agreement is unenforceable, the remaining portions shall remain
in full force and effect. All participants are subject to acceptance by Barbara
Molin and Seagypsy Expeditions.
This agreement shall be deemed to have been entered into in Kelowna, British
Columbia, Canada. In the unlikely event a legal dispute should arise, I agree the
dispute shall exclusively be brought before the appropriate court in Kelowna,
British Columbia, Canada.
I have read this Agreement of Release of Liability, Agreement To Hold Harmless
And Indemnify, and Assumption of Risk, and understand its terms. I execute it
voluntarily and with the full knowledge of its significance.
